Le proc\u00e8s, pr\u00e9vu pour le <strong>deuxi\u00e8me trimestre 2024<\/strong>, vise \u00e0 r\u00e9soudre le proc\u00e8s initi\u00e9 par la <a href=\"https:\/\/captain-trading.com\/actu-crypto\/category\/sec\/\" target=\"_blank\" rel=\"noopener\">SEC<\/a> contre <a href=\"https:\/\/ripple.com\/\" target=\"_blank\" rel=\"noopener\">Ripple<\/a> Labs et deux de ses dirigeants, le PDG Brad Garlinghouse et le pr\u00e9sident ex\u00e9cutif Chris Larsen. La <a href=\"https:\/\/captain-trading.com\/actu-crypto\/category\/sec\/\" target=\"_blank\" rel=\"noopener\">SEC<\/a> all\u00e8gue que <a href=\"https:\/\/ripple.com\/\" target=\"_blank\" rel=\"noopener\">Ripple<\/a> Labs a vendu un titre non enregistr\u00e9, le <a href=\"https:\/\/captain-trading.com\/actu-crypto\/category\/ripple-xrp\/\" target=\"_blank\" rel=\"noopener\">XRP<\/a>, en violation de la loi sur les valeurs mobili\u00e8res de 1933. La SEC a \u00e9galement accus\u00e9 Garlinghouse et Larsen d\u2019avoir aid\u00e9 et encourag\u00e9 les violations pr\u00e9sum\u00e9es de Ripple.<\/p>\n<h2><b>D\u00e9cision de Torres, juge du proces XRP<br \/>\n<\/b><\/h2>\n<p>Le 13 juillet 2023, la juge Analisa Torres a rendu une d\u00e9cision historique devant le tribunal de district des \u00c9tats-Unis pour le district sud de New York. Le tribunal a accept\u00e9 la demande de jugement sommaire de la SEC concernant les ventes institutionnelles, mais l\u2019a rejet\u00e9e pour d\u2019autres questions. Ripple, en revanche, s\u2019est vu accorder un jugement sommaire pour les ventes programmatiques, les autres distributions et les ventes effectu\u00e9es par Larsen et Garlinghouse, mais l\u2019a refus\u00e9 pour les ventes institutionnelles. Le tribunal a \u00e9galement <strong>rejet\u00e9 la demande de jugement sommaire de la SEC<\/strong> concernant l\u2019accusation de complicit\u00e9 \u00e0 l\u2019encontre de Larsen et Garlinghouse.<\/p>\n<h2><b>L\u2019\u00e9valuation par le juge des ventes de XRP<br \/>\n<\/b><\/h2>\n<p>Le juge Torres a sp\u00e9cifiquement abord\u00e9 les ventes de <a href=\"https:\/\/captain-trading.com\/actu-crypto\/category\/ripple-xrp\/\" target=\"_blank\" rel=\"noopener\">XRP<\/a> de Larsen et Garlinghouse, d\u00e9clarant qu\u2019il s\u2019agissait de ventes programmatiques r\u00e9alis\u00e9es sur divers \u00e9changes d\u2019actifs num\u00e9riques. Ces ventes ont \u00e9t\u00e9 effectu\u00e9es <strong>par le biais de transactions bid\/ask aveugles o\u00f9 les acheteurs et les vendeurs ne connaissaient pas l\u2019identit\u00e9 de l\u2019autre<\/strong>. Le juge a d\u00e9termin\u00e9 que ces transactions ne r\u00e9pondaient pas aux crit\u00e8res \u00e9tablis dans le test Howey, qui d\u00e9termine l\u2019existence d\u2019un contrat d\u2019investissement. Par cons\u00e9quent, le tribunal a conclu que les ventes de Larsen et Garlinghouse ne constituaient pas des offres et des ventes de contrats d\u2019investissement.<\/p>\n<h2><b>Prochaines \u00e9tapes du proces XRP<br \/>\n<\/b><\/h2>\n<p>La juge Torres a indiqu\u00e9 qu\u2019elle rendrait une autre ordonnance \u00e0 l\u2019avenir pour fixer une date de proc\u00e8s et fixer des d\u00e9lais avant le proc\u00e8s. Par la suite, le <strong>9 ao\u00fbt, la juge Torres a d\u00e9pos\u00e9 une ordonnance de mise au r\u00f4le avant le proc\u00e8s<\/strong>, annon\u00e7ant la pr\u00e9paration du tribunal pour un proc\u00e8s avec jury impliquant les trois d\u00e9fendeurs. Les parties devaient fournir des dates d\u2019interdiction avant le 23 ao\u00fbt, le proc\u00e8s devant avoir lieu entre le 1er avril et le 30 juin 2024.<\/p>\n<h2><b>Disponibilit\u00e9s pour le proces XRP<br \/>\n<\/b><\/h2>\n<p>Les avocats de Garlinghouse et de Larsen ont d\u00e9clar\u00e9 que <strong>les accus\u00e9s seraient indisponibles pour le proc\u00e8s du 1er au 14 avril 2024<\/strong>. D\u2019autre part, Ripple Labs a d\u00e9clar\u00e9 qu\u2019ils n\u2019avaient pas de dates d\u2019interdiction et qu\u2019ils seraient disponibles pour le proc\u00e8s tout au long du deuxi\u00e8me trimestre 2024. Les avocats de la SEC ont indiqu\u00e9 les dates d\u2019interdiction du 15 au 19 avril, du 1er au 7 mai et du 27 au 31 mai pour le deuxi\u00e8me trimestre 2024.<\/p>\n<p style=\"text-align:
