Un juge am\u00e9ricain s\u2019est prononc\u00e9 vendredi sur les poursuites engag\u00e9es par la Securities and Exchange Commission<\/a> (SEC<\/a>) contre Binance<\/a> et son ancien PDG Changpeng Zhao<\/em>. Sur les 13 chefs d\u2019accusation pr\u00e9sent\u00e9s, 10 seront poursuivis tandis que trois pourraient \u00eatre rejet\u00e9s enti\u00e8rement ou partiellement.<\/p>\n

All\u00e9gations du proc\u00e8s de la SEC<\/b><\/h2>\n

La SEC<\/a> a intent\u00e9 une action en justice le 5 juin de l\u2019ann\u00e9e derni\u00e8re contre Binance<\/em>, Binance<\/em> US<\/em> et Zhao<\/em>, all\u00e9guant une mauvaise gestion des fonds des clients, le commerce de jetons et l\u2019utilisation de Binance US pour d\u00e9tourner l\u2019attention de la r\u00e9glementation.<\/p>\n

Binance – SEC investigation | D\u00e9cision du juge<\/b><\/h2>\n

La juge Amy Berman Jackson a rejet\u00e9<\/strong> l\u2019argument de Binance<\/a> selon lequel la SEC ne disposait pas d\u2019un pr\u00e9avis \u00e9quitable pour les mesures d\u2019application. Ensuite, elle a d\u00e9clar\u00e9 que l\u2019industrie crypto avait \u00e9t\u00e9 avertie de se conformer aux lois f\u00e9d\u00e9rales sur les valeurs mobili\u00e8res. Elle a aussi soulign\u00e9 que l\u2019autorit\u00e9 de la SEC n\u2019\u00e9tait pas une prise de pouvoir incontr\u00f4l\u00e9e.<\/p>\n

Accusations rejet\u00e9es et confirm\u00e9es<\/b><\/h2>\n

La juge Jackson a confirm\u00e9 le rejet de trois accusations, dont une li\u00e9e \u00e0 la vente du stablecoin<\/strong> BUSD<\/strong>. Elle a rejet\u00e9 les accusations du programme d\u2019int\u00e9r\u00eat pour les jetons Simple Earn<\/em> et les ventes de jetons BNB<\/em><\/a> par des tiers.<\/p>\n

La SEC soutient que les crypto-actifs de Binance sont des titres en vertu des lois pertinentes datant de 1946. La prochaine audience est fix\u00e9e au 9 juillet, m\u00eame si Zhao<\/strong> <\/em>reste incarc\u00e9r\u00e9 pour d\u2019autres chefs d\u2019accusation.<\/p>\n
